1. Agreement to Terms

These Terms of Service (“Terms”) constitute a legally binding agreement between you and Plus Ultra Health Pty Ltd (“Plus Ultra Health”, “we”, “us”, or “our”) governing your access to and use of the Eliya mobile application, web platform, and related services (collectively, the “Services”).

By creating an account or using our Services, you agree to be bound by these Terms.

2. Eligibility

You must be at least 18 years of age to use our Services. You agree to provide accurate, current, and complete information, maintain and promptly update your account information, keep your password secure and confidential, and accept responsibility for all activities under your account.

3. Description of Services

Plus Ultra Health provides a digital fitness and rehabilitation platform that includes personalised exercise programs, an exercise library with video demonstrations, progress tracking tools, optional connection with healthcare practitioners, and educational content.

Our Services are not medical advice, diagnosis, or treatment. We are a general wellness application, not a medical device or healthcare service. If you have a medical condition, injury, or health concern, consult a qualified healthcare professional before using our Services.

4. Important Health Disclaimers

Our Services are intended for general fitness and wellness purposes only. Physical exercise carries inherent risks. By using our Services, you acknowledge that exercise may result in physical injury, you are responsible for your own physical condition and limitations, you should consult a healthcare professional before starting any exercise program, and you should stop exercising immediately if you experience pain, dizziness, or discomfort. We do not guarantee any specific results from using our Services.

5. User Responsibilities

You agree to use our Services only for lawful purposes. You must not violate any applicable laws or regulations, infringe on the rights of others, upload harmful, offensive, or inappropriate content, or attempt to gain unauthorised access to our systems.

6. Intellectual Property

All content included in or made available through the Services is owned by Plus Ultra Health or our licensors and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Services for your personal, non-commercial use.

7. Fees and Payment

Our Services are currently offered free of charge. We reserve the right to introduce paid features in the future with advance notice.

8. Privacy

Our collection and use of personal information is governed by our Privacy Policy.

9. Disclaimer of Warranties

To the maximum extent permitted by law, our Services are provided “as is” without warranties of any kind. Nothing in these Terms excludes consumer guarantees under the Australian Consumer Law.

10. Limitation of Liability

To the maximum extent permitted by law, Plus Ultra Health will not be liable for any indirect, incidental, special, consequential, or punitive damages. Our total liability is limited to the greater of AUD $100 or the amount you paid us in the 12 months before the claim arose.

11. Termination

You may terminate your account at any time through the Settings menu or by contacting support@plusultrahealth.com. We may suspend or terminate your account if you breach these Terms.

12. Dispute Resolution

These Terms are governed by the laws of Victoria, Australia. Any legal action must be brought in the courts of Victoria, Australia.

13. Changes to These Terms

We may modify these Terms at any time with notice. Your continued use constitutes acceptance of the modified Terms.
